What is the right to nominate under DPDP?
You can name someone to use your DPDP data rights if you die or become unable to use those rights yourself. That person is your nominee.
Example: asking for a customer’s data
- A customer names their sister as a nominee. After the customer dies, she contacts the company about their personal data.
- The company checks who she is, the nomination and the documents needed for her request.
What a company can prepare
- Give customers a way to add or change a nominee.
- Name the team that will receive these requests.
- Agree which documents the team needs to check and who will decide the request.
- Save the decision and reply. Keep access limited to the staff handling the request.
What the Act says
- Section 14 gives this right in the event of death or incapacity. The steps for using it are set by the rules.
- The provision takes effect on 13 May 2027.
