The CA logic
You file GST and income tax through a CA. You hired one because the law created an obligation, the obligation carries consequences, and a named accountable professional costs less than facing those consequences alone.
That is the whole logic. A Data Protection Officer is the same decision applied to personal data.
What the law actually says
The DPDP Act makes a DPO mandatory for Significant Data Fiduciaries: the DPO must be based in India and answer at board level. Every other company still has to publish a contact who can answer data questions.
The formal exemption is thinner than it looks. When a breach reaches the Data Protection Board, the first question is who was responsible for protecting this data. A company that answers "nobody specifically" walks into the penalty discussion with no accountability trail, no documentation, and no one who can demonstrate reasonable safeguards.
The qualification surprise
The Act prescribes zero examinations and zero certificates for the role. It asks for a person who is capable of doing the job and reachable for grievances.
One trained person can also serve several companies, the way one CA serves fifty clients across GST and income tax. That makes a fractional DPO possible at a fraction of a full-time salary.
The job in plain terms
- Own the company's data hygiene and be accountable for it.
- Handle user rights requests: access, correction, deletion.
- Run breach response when something goes wrong.
- Keep the compliance documentation current.
